How Gratuity Works for Dubai Employees

Dubai employees working in the mainland (outside free zones) are entitled to end-of-service gratuity under UAE Federal Labour Law. Gratuity is calculated based solely on your basic salary — housing, transport, performance bonuses, and other allowances are excluded.

Dubai vs DIFC — Key Difference

If your employer's registered address is in the Dubai International Financial Centre (DIFC), you are likely enrolled in the DEWS (Workplace Savings) scheme instead of receiving a lump-sum gratuity. Under DEWS, your employer contributes a monthly percentage to an investment fund on your behalf. Check with your HR department to confirm which scheme applies to you.

Eligibility & Key Rules

  • Minimum service: 1 complete year with the same employer.
  • Calculation base: Basic salary only — no allowances or bonuses included.
  • Maximum cap: Total gratuity cannot exceed 2 years of basic salary.
  • Payment deadline: 14 days after the last working day (Article 53).
  • Contract type (from Feb 2022): All new contracts are limited (fixed-term). Resignation and termination now treated identically for gratuity purposes.

Is Dubai gratuity different from the rest of the UAE?

No. Dubai private sector employees are governed by the UAE Federal Labour Law (Federal Decree-Law No. 33 of 2021). The gratuity formula — 21 days' basic pay per year for the first 5 years, then 30 days per year thereafter — applies across all UAE emirates for mainland companies. The only exception is the DIFC free zone, which operates its own DEWS (Workplace Savings) scheme instead.

When is gratuity paid in Dubai?

Under Article 53 of UAE Labour Law, your employer must settle all final dues — including gratuity — within 14 days of your last working day. If they fail to do so, you can file a complaint with MOHRE at mohre.gov.ae or via the MOHRE app.

What is the minimum service period to get gratuity in Dubai?

You must complete at least 1 continuous year of service with the same employer to qualify for any gratuity. There is no pro-rated gratuity if you leave before completing 12 months.

Does Dubai gratuity apply to free zone employees?

Dubai has several free zones including JAFZA, DMCC, and DIFC. JAFZA and DMCC employees generally follow UAE Federal Labour Law for gratuity. DIFC employees are typically enrolled in the DEWS savings scheme instead. Always check your employment contract and the applicable free zone authority rules.

How is gratuity calculated in Dubai for resignation vs termination?

Under the 2023 UAE Labour Law, all UAE contracts are limited (fixed-term). Whether you resign or are terminated, the same full gratuity formula applies. The old unlimited contract rules that reduced gratuity for early resignation are no longer issued for new contracts — though existing unlimited contracts signed before February 2022 retain the old calculation rules until they expire or are converted.

What is the maximum gratuity amount in Dubai?

The total gratuity cannot exceed two years of your last drawn basic salary. For example, if your basic salary is AED 10,000/month, the maximum possible gratuity is AED 240,000 (24 months × AED 10,000).
