How is end of service gratuity calculated in UAE 2026?

Under the UAE Labour Law (MOHRE), gratuity is calculated based on 21 days of basic salary for each year of the first five years, and 30 days for every year thereafter, provided the total doesn't exceed two years' basic salary.

What is the official UAE labour law formula for gratuity?

The official formula depends on your service period. For 1-5 years: (Basic Salary ÷ 30) × 21 × Years. For 5+ years: [(Basic Salary ÷ 30) × 21 × 5] + [(Basic Salary ÷ 30) × 30 × (Years - 5)]. This is the standard MOHRE calculation.

Is gratuity calculated on gross salary or basic salary?

In both India and UAE, gratuity is calculated on Basic Salary only (plus DA in India). HRA, transport allowance, bonuses, and special allowances are excluded from the calculation base.

What happens if my employer does not pay gratuity on time?

In India, payment is due within 30 days; delays attract interest. In the UAE, all final dues must be cleared within 14 days of the last working day under Article 53 of the UAE Labor Law. You can file complaints with either the Labour Commissioner (India) or MOHRE (UAE).
